This Privacy Policy is incorporated by reference into the Brandle, Inc. Terms of Use. The term, “Brandle,” “we,” and “us” includes Brandle, Inc. and our affiliates and subsidiaries. The Privacy Policy explains how Brandle, Inc. may:
- collect,
- use, and
- disclose
information we obtain through the Brandle Service and other Brandle business.
“Personal Information” means information that alone or when in combination with other information may be used to readily identify, contact, or locate you, such as: name, address, email address, or phone number. We do not consider Personal Information to include information that has been anonymized so that it does not allow a third party to easily identify a specific individual.
There are five areas for storing Personal Information:
- Brandle Presence Manager User Database (Brandle as "Data Controller")
- Brandle Presence Manager Customer Contacts Database (Brandle as "Data Processor")
- Brandle Support Database (Brandle as "Data Controller")
- Marketing and Sales Database (Brandle as "Data Controller")
- Brandle Customer Product Updates Database (Brandle as "Data Controller")
To support these five areas, we have three key databases that house Personal Information:
The Brandle Service which houses the Brandle Presence Manager User Database and Customer Contacts Database.
The Brandle Customer Support system which houses the technical and user support database.
The Brandle Marketing System which houses the Brandle Account User database to receive Product Update information and the Marketing and Sales database.
The Brandle Service Collects Your Information
The Brandle Service is the Software as a Service that we license to customers. The Brandle Service includes the Brandle Presence Manager and the optional modules that can be licensed to augment the service. We collect Personal Information when:
- you register to use the Brandle Service;
- someone invites you to use the Brandle Service;
- you log in with social networking credentials; and
- you communicate with us.
We collect the information you submit while you use the Brandle Service, such as information about POPs and activity that occurs on POPs (points-of-presence such as social media accounts, pages, websites, and domains. ). We also collect information, such as anonymous usage statistics, by using cookies, server logs, and other similar technology as you use the Brandle Service.
Registration. To create an account, you may need to provide Personal Information, such as your name, username, password, email address, billing address, and telephone number. You may also provide other optional information.
Invitations to Use the Brandle Service. We may collect your name and email address if another user submits the information to invite you to use the Brandle Service. An invitation is generally sent by an existing user of a corporate account to other team members who will perform work within the Brandle Service as part of their job.
Social Log-In. When you use your social media credentials to log into the Brandle Service, we collect Personal Information from the social media website. For example, when you log in with your Facebook credentials, we may collect the Personal Information you have made publicly available in Facebook, such as your name and profile picture or logo. We may also collect the number of friends or connections you have.
POP Activity. When you add a POP (point-of-presence) to your Brandle account, whether corporate-owned or owned by a third-party that relates to your corporation, we may collect information, including Personal Information, you and others have made public on the POP and information about POP activity. Specifically, Brandle collects information made available by social media sites such as Twitter, Facebook, Instagram, Pinterest, YouTube, Google, and others through APIs or social media monitoring technology (“Third Party Sites”). This data includes names, user IDs, social media handles, and other information that individuals choose to make publicly available on social media sites. Brandle also monitors the public activities of individuals on social media sites, including posts, blogs, tweets, and profile information, including such social media messages directed at our customers (the “brands” that are interested in understanding their consumer customers in order to serve them better).
Note that any direct or indirect use of any social media network or other third party site through our Services is subject to your consent of the legal terms of that site, such as their respective terms of use and privacy policy. For your convenience, we've listed some of the most used sites with links to their main terms below (most terms also have additional policies linked to within the main terms). Note that we endeavor to keep these links updated, but they are subject to change. Regardless, you agree to locate and abide by all the third party terms that apply to you.

This Privacy Notice does not govern the collection of content by Third Party Sites that is not published or generated through the Services, except to the extent that we act as a processor with respect to such content. Making Payments. When you make payments through the Brandle Service, you may need to provide Personal Information to our third-party service providers, such as your credit card number. We do not collect any of the Personal Information you provide to make a payment, but we may collect information about the payment, such as the date and amount of the payment.
Cookies, Automatic Data Collection, and Related Technologies. The Brandle Service collects and stores information that is generated automatically as you use it, including your preferences and anonymous usage statistics.
When you visit the Brandle Service, we and our third-party service providers receive and record information on our server logs from your browser, including your IP address, and from cookies and similar technology. Cookies are small text files placed in visitors’ computer browsers to store their preferences. Most browsers allow you to block and delete cookies. However, if you do that, the Brandle Service may not work properly.
By using the Brandle Service, you are authorizing us to gather, parse, and retain data related to the provision of the Brandle Service.
How Brandle Uses Your Information
We use Personal Information to
- facilitate and improve the Brandle Service; and
- communicate with you.
We do not rent, sell, or share Personal Information about you with other people or nonaffiliated companies for their direct marketing purposes. We may use aggregate information for any purpose, including for marketing purposes.
Internal and Service-Related Usage. We use information, including Personal Information, for internal and service-related purposes only and may provide it to third parties to allow us to facilitate the Brandle Service. We may use and retain any data we collect to provide and improve our services.
Communications. We may send email to the email address you provide to us to verify your account and for informational and operational purposes, such as account management, or system maintenance.
Marketing. We do not rent, sell, or share Personal Information about you with other people or nonaffiliated companies for their direct marketing purposes. We may use your Personal Information to facilitate transmittal of information that may be useful, relevant, valuable or otherwise of interest to you.
Aggregate Data. We may anonymize and aggregate data collected through the Brandle Service and use it for any purpose.
Brandle May Disclose Your Information
We may share your information:
- with our third-party service providers;
- to third-party vendors to which your company has provided access via the Brandle API
- on the Brandle Service and to search engines if you decide to make it public;
- to comply with legal obligations;
- to protect and defend our rights and property; and
- with your permission.
We Use Vendors and Service Providers. We may share any information we receive with vendors and service providers retained in connection with the provision of the Brandle Service. We may also share information with vendors that the customer has requested have access to their Brandle information via Brandle’s Application Programming Interface (API).
Displaying to Other Users. The POPs you to decide to make public may be displayed on the Brandle Service and be accessible via a Brandle search by people with whom you share the search link. You may limit access to this information by changing your settings.
Brandle Customer Support Collects Your Information
Customer Support. We may collect Personal Information through your communications with our customer-support system. Our customer support system is a separate system than the Brandle Service and can be accessed via the Brandle Service when requesting technical support or by searching Brandle FAQ and submitting a request.
Information collected in the Brandle Support system may include your name, email, the subject and nature of your request, and any attachment you add to the request.
Communications. We may send email to the email address you provide to us to verify your account and for informational and operational purposes, such as customer service and technical support.
Brandle Marketing System Collects Information
Brandle Sales and Marketing. Brandle collects Personal Information through your communication with us on our website when you submit information on website forms or make a request to be contacted. Brandle also collects Personal Information at sales and marketing events such as tradeshows, conferences, and general meetings. This information is kept in a separate database for sales and marketing purposes.
This database also houses customer Personal Information as it is the system that sends Brandle Feature Updates and announcement emails to customers.
We do not rent, sell, or share Personal Information about you with other people or nonaffiliated companies for their direct marketing purposes. We may use your Personal Information to facilitate transmittal of information that may be useful, relevant, valuable or otherwise of interest to you.
Communications Preferences. You may manage your receipt of marketing and sales or Brandle update emails by selecting to Unsubscribe or Change Email Preferences at the bottom of every email sent through this system.
Form OPT-IN Required. As of May 7, 2018, all website form submittals have a required Opt-In field that clearly states that personal information submitted on the form will be collected in the Marketing database. A user must check this opt-in box in order to continue with the download or form submittal in order to give approval for their information to be submitted.

The remaining segments of this Privacy Policy apply to all databases stated within the policy.
As Required By Law and Similar Disclosures. We may access, preserve, and disclose your Personal Information, other account information, and content if we believe doing so is required by law or if those actions are reasonably necessary to:
- comply with legal process, such as a court order or subpoena;
- enforce this Privacy Policy or our Terms of Use;
- respond to claims that any content violates the rights of third parties;
- respond to your requests for customer service;
- respond to law enforcement;
- investigate and prevent unauthorized transactions or other illegal activities; or
- protect our or others’ rights, property, or personal safety.
Merger, Sale, or Other Asset Transfers. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, your information may be sold or transferred as part of such a transaction. Any entity receiving such information may choose to treat such information according to its privacy policy and not the terms of this Privacy Policy.
We may also disclose your Personal Information with your permission.
Security of Your Information
We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us. We do not accept liability for unintentional disclosure.
By using the Brandle Service or providing Personal Information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Brandle Service. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on the Brandle Service or sending an email to you. You may have a legal right to receive this notice in writing. To receive free written notice of a security breach (or to withdraw your consent from receiving electronic notice), please notify us at support@brandle.net.
International Users
By using the Brandle Service, or otherwise provide information to us, you will transfer data to the United States.
By choosing to visit the Brandle Service or otherwise provide information to us, you agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the law of the state of California and the adjudication of any disputes arising in connection with Brandle, Inc. or the Brandle Service will be in accordance with the Terms of Use.
If you are visiting from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your information to the United States and processing globally. By providing your information you consent to any transfer and processing in accordance with this Policy.
If you live in a country governed by the European Union GDPR (General Data Protection Regulation), then you have already been contacted to opt-in to the Brandle Marketing database. If you did not opt-in, then your Personal Information was removed. If you wish to request a review of your information in the Brandle Service you may write to support@brandle.net or access the GDPR form within your Brandle account.
Update Your Information or Pose a Question or Suggestion
If you would like to update, correct, or delete any information that you have provided to us through your use of the Brandle Service or otherwise, or if you have suggestions for improving this Privacy Policy, please send an email to support@brandle.net.
Changes to our Privacy Policy and Practices
We may revise this Privacy Policy, so review it periodically.
We may revise this Privacy Policy, so review it periodically. Before we broaden our use of Personal Information beyond what is stated in this Privacy Policy, we will make reasonable efforts to provide notice and obtain consent as required by law.
Posting of Revised Privacy Policy. We will post any adjustments to the Privacy Policy on this web page, and the revised version will be effective when it is posted. If you are concerned about how your information is used, bookmark this page and read this Privacy Policy periodically.
New Uses of Personal Information. From time to time, we may desire to use Personal Information for uses not previously disclosed in our Privacy Policy. If our practices change regarding previously collected Personal Information in a way that would be materially less restrictive than stated in the version of this Privacy Policy in effect at the time we collected the information, we will make reasonable efforts to provide notice and obtain consent to any such uses as may be required by law.
